These Terms & Conditions (“Terms”) govern your access to and use of Chowseek’s mobile application, website, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1. Eligibility and accounts
You must be legally capable of entering into these Terms and meet any minimum age required by applicable law. You are responsible for maintaining the security of your account and for activity that occurs through it. You agree to provide accurate information and notify us of suspected unauthorized use.
2. What Chowseek provides
Chowseek helps users discover restaurants and food-related places using search prompts, location context, place information, recommendation signals, maps, and related features. Recommendations are informational and may be generated or ranked using automated systems and third-party data.
3. Recommendation and place-data limitations
Restaurant details can change quickly. We do not guarantee that recommendations, operating hours, prices, menus, dietary information, accessibility details, distances, availability, ratings, or other place information are complete, current, or error-free. You should independently confirm information that matters to your health, safety, dietary requirements, travel, or purchase decision.
Chowseek is not a medical or allergy-safety service. If you have allergies or other health-related dietary restrictions, confirm ingredients, cross-contact risks, and preparation practices directly with the restaurant.
4. Location and navigation
Location, map, distance, and navigation features may depend on device permissions and third-party providers. Routes and location estimates may be inaccurate or unavailable. Use appropriate care and follow local laws when traveling.
5. Subscriptions and billing
Some Chowseek features may require a paid subscription. Available plans, prices, billing periods, taxes, trial terms, and renewal details will be shown at or before purchase. Unless otherwise stated at purchase, subscriptions may renew automatically until canceled.
You authorize the applicable payment provider to charge the displayed amounts according to the plan you select. Manage or cancel subscriptions using the method presented in the Services or through the applicable app store or billing portal. Refunds, if any, are subject to the purchase channel’s rules and applicable law.
6. Acceptable use
You may not misuse the Services, attempt to gain unauthorized access, interfere with security or integrity measures, reverse engineer the Services except where law expressly permits it, use automated means to scrape or overload the Services, impersonate others, submit unlawful content, or use the Services to violate law or third-party rights.
7. Your content
You retain ownership of content you submit, such as search prompts, notes, and saved information. You grant us a limited license to host, process, reproduce, and transmit that content as necessary to operate, secure, and improve the Services. You represent that you have the rights needed to submit the content.
8. Intellectual property
The Services, including software, branding, interfaces, designs, text, and other materials provided by Chowseek, are owned by or licensed to us and are protected by applicable intellectual-property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose.
9. Third-party services
The Services may integrate with or link to third-party services, including maps, navigation, authentication, payment, app-store, and place-information providers. We do not control those services, and your use of them may be subject to separate terms and policies.
10. Service changes and termination
We may modify, suspend, or discontinue features, or impose reasonable limits, to maintain, improve, secure, or change the Services. You may stop using Chowseek at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, or misused the Services.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Chowseek and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill arising from or related to the Services. Any additional liability cap should be reviewed and customized by legal counsel for your entity and jurisdictions.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Chowseek and its affiliates, officers, and employees from claims, liabilities, damages, and expenses arising from your unlawful misuse of the Services or material breach of these Terms.
14. Governing law and disputes
These Terms are governed by applicable law, without limiting any mandatory consumer protections that apply where you live. Any dispute will be handled in a court or forum with proper jurisdiction unless you and Chowseek agree to another lawful method of resolving the dispute.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version and revise the effective date. Continued use after an update becomes effective constitutes acceptance to the extent permitted by law.
